Constitutional Amendment - Provides that the people of the several States and the District of Columbia shall elect the President and Vice President who shall be joined as candidates.
Requires the electors of President and Vice President in each State to have the qualifications requisite for electors of the branch of the State legislature that has the greatest number of members.
Provides that the persons joined as candidates having the greatest number of votes for President and Vice President shall be elected, if such number be at least 40 percent of the whole number of votes cast. Provides that if no person has such number, a runoff election shall be held in which the choice of President and Vice President shall be made from the persons who received the two highest President and Vice President.
Requires: (1) each State legislature to determine the time, place, and manner of elections, which may be altered by the Congress; and (2) the Congress to determine the days for elections and the manner in which the results shall be ascertained and declared, but no election other than a runoff election shall be held later than the first Tuesday after the first Monday in November.
Authorizes the Congress to provide for cases of the pre-election death, inability, or withdrawal of a candidate for President or Vice President.
