Data Protection Act of 1989

Data Protection Act of 1989 - Amends the Privacy Act of 1974 to establish the Data Protection Board as an independent agency of the executive branch.

Requires the Board to develop guidelines and regulations to implement the Privacy Act of 1974 and the Freedom of Information Act. Directs the Board to assist Federal agencies in implementing such Acts. Allows the Board to: (1) issue advisory opinions; (2) investigate compliance with such Acts; (3) report violations of such Acts to an agency, the President, the Attorney General, and the Congress; and (4) file comments with the Office of Management and Budget and any Federal agency on any proposal regarding such Acts. Permits the Board to review Federal, State, and local laws, executive orders, and judicial decisions and report on the extent to which they are consistent with data protection rights and standards and fair information practices.

Allows the Board to conduct, assist, and support research in areas relating to privacy.

Directs Federal agencies and departments to furnish, upon request, data, reports, and information the Board deems necessary to carry out its functions.

Requires the Board to report annually to the President and the Congress on its activities.
