Directs the Secretary of the Army, acting through the Chief of Engineers, to rehabilitate the Gallipolis Dam, Ohio and West Virginia, and to replace certain locks on the Ohio River.
Directs the Secretary to mitigate fish and wildlife habitat losses resulting from such construction by purchasing, at Federal expense, specified lands near Glenwood Bend, West Virginia. Authorizes the Secretary to transfer such land to the State of West Virginia for operation and maintenance.
Exempts from judicial review the environmental impact statement for this project and actions to carry it out, except as specified. Provides that claims alleging the invalidity of this Act, or the invalidity or unconstitutionality of implementing actions, shall be brought only in a United States district court for a district in which a portion of the navigation project is located. Sets forth procedures for expedited judicial review.
Prohibits such a court from granting injunctive relief against any actions pursuant to this Act except in conjunction with a final judgment.
Provides that a review of judgments, decrees, or orders may be had only upon direct appeal to the Supreme Court of the United States.
Prohibits the bringing of any action to enjoin work on such construction, unless the petitioner provides a bond.
Authorizes appropriations. Authorizes the Secretary, pending appropriation of such sums, to allot necessary amounts from existing Army department civil works appropriations.
