Prohibits a franchisor from operating or authorizing the operation of any marketing premises for a product or service under a trademark in the marketing area of an existing marketing premises for such product or service.
Excludes from such prohibition new premises which it is anticipated will not reduce the existing franchise's sales by ten percent or more. Subjects disagreements on such exclusion to arbitration.
Entitles an invaded franchisee to civil relief and to attorney's fees if such franchisee prevails. Reserves the question of exemplary damages to the court.
Supersedes all State and local law in such area.
