Allows parties that prevail against the United States in specified administrative and judicial proceedings to be awarded attorney fees and other expenses. Permits the relevant agency or court to assess a civil penalty against an officer or employee of the United States if such agency or court determines that the proceeding involved was based on a clearly arbitrary or capricious action of such officer or employee.
