Amends the Federal Mine Safety and Health Act of 1977 to include any independent contractor (other than a construction contractor) performing services at a mine in the definition of an "operator." Exempts from the requirements of the Act any independent construction contractor engaged by an operator for the construction, repair, or alteration of structures, facilities, utilities, or private ways or roads located on the surface area of any mine or as an excavations or equipment installations attendant to such activities. Requires the independent contractor's employees to: (1) enter their work area through access routes reserved for them; and (2) work in areas which are separate from mining or excavation activities.
Requires the operator of a mine at which any construction activity is undertaken by an independent construction contractor to notify the Occupational Safety and Health Administration of the type of activity and number of employees involved.
