A bill to amend the Occupational Safety and Health Act of 1970 to exempt small businesses having no more than ten full-time employees or the equivalent thereof, and does not have an occupational injury incidence rate exceeding seven per hundred full-time employees based upon the annual Bureau of Labor Statistics survey of 3-and 4-digit Standard Industrial Classification Code industries.

Amends the Occupational Safety and Health Act of 1970 to exclude from the definition of employer any person with no more than ten full-time employees and with an occupational injury incidence rate not exceeding seven percent.

Provides, with regard to such small businesses, that: (1) the Secretary of Labor may conduct health inspections and investigate serious injuries or deaths involving workplace safety; (2) employees or their representatives may request an inspection by filing a written complaint with the Secretary; and (3) citations may only be issued if the violating condition created a serious risk and was knowingly or recklessly permitted to exist.

Directs the Secretary to publish annually in the Federal Register the occupational injury incidence rate for such employer category.
