Repeals the Gun Control Act of 1968. Reenacts the Federal Firearms Act and the former provision of the Internal Revenue Code relating to machineguns and other firearms.
Amends the Federal criminal code to establish mandatory penalties for: (1) using or carrying unlawfully a firearm to commit a felony which may be prosecuted in Federal court; or (2) using or carrying unlawfully a firearm to commit a felony as determined by State law. Sets the term of imprisonment at one to ten years for a first offender and two to 25 years for a second or subsequent offender. Disallows in the case of a second or subsequent offender a suspended or probationary sentence or concurrent sentence running with the term of imprisonment imposed for the offense itself.
