A bill to authorize the waiver in certain circumstances of the reimbursement requirement under section 5003(a) of Title 18 of the United States Code, to relieve the State of New Mexico of certain liability, and for other purposes.
Emergency Federal Prison Facilities Act - Authorizes the Attorney General, in consultation with the Director of the Bureau of Prisons, to waive, in the case of a State prison emergency, the current requirement that a State reimburse the United States for the full cost of the placement of State prisoners in a Federal facility.
Relieves the State of New Mexico from any liability for such reimbursement which arose prior to enactment as the result of the prison disruption in the New Mexico State Penitentiary in February, 1980.
Requires the Director to report to the congressional judiciary committees by January 31, 1981, on the actual costs incurred by Federal facilities for the temporary placement of such State prisoners.
