A bill to amend title 5, United States Code, to permit court review in cases involving employees separated under section 8347, title 5, United States Code.
Permits a Federal employee who is found by the Office of Personnel Management to be mentally disabled pursuant to an application by such employee's agency for the diaability retirment of such employee: (1) to appeal such finding for review by the Merit Systems Protection Board; and (2) to appeal an adverse decision of the Board for review by a United States Court of Appeals or the Court of Claims.
