Requires that medical records maintained by the United States, or in connection with programs assisted by the United States, or insurance companies engaged in business in interstate commerce be confidential and be disclosed only according to this Act.
Allows such records to be disclosed with prior written consent of the patent and without the patients consent under the following circumstances; (1) a medical emergency; (2) scientific research or audits; or (3) an order of a court of competent jurisdiction.
Sets penalties for violation of this Act and allows any injured party to bring a civil action against the person who discloses such records.
