Amends Title XVI (Supplemental Security Income) of the Social Security Act to require the Secretary of Health, Education, and Welfare) to set and pay a reasonable attorneys fee in any claim before the Secretary for benefits under that Title where the claimant is successful, represented by an attorney, and entitled to past-due benefits.
Provides that whenever a court renders a judgment favorable to a claimant under Title XVI the court may determine and allow a reasonable attorneys fee where the claimant was represented by an attorney. Sets forth criminal penalties for any attorney charging any fee in excess of that allowed by the court.
