A bill to amend the Occupational Safety and Health Act of 1970 to bar the issuance of citations to employers of less than 10 persons and to bar the assessment of penalties where fewer than 10 nonserious violations are cited.

Amends the Occupational Safety and Health Act to prohibit the issuance of a citation to an employer who has not at any time 30 days prior to an inspection or investigation employed more than ten employees.

Exempts an employer charged with a nonserious violation from assessment of a civil penalty if he (1) has not been previously cited for the same violation; and (2) is charged with ten or less nonserious violations.
