A bill to amend certain provisions of the Controlled Substances Act relating to marijuana.

Provides that it shall not be unlawful for any person: (1) to possess, within a private dwelling, marihuana for his own or others' use, within any such dwelling, if such marihuana is not possessed with the intent to be distributed, transferred, or sold in violation of the Controlled Substances Act or any other Federal law; (2) to possess, in a public area, marihuana in a reasonable amount if the possession of such marihuana is incident to a private use, and is not with the intent to distribute, transfer, or sell such marihuana; or (3) to distribute, transfer, or sell, in public or private, any marihuana, lawfully possessed, to any person for a private use, if such distribution, transfer, or sale is not made for profit.

Provides that in the prosecution of any person charged with an offense in violation of any Federal law, the fact that such person was suffering from marihuana intoxication at the time of the commission of the offense shall not be a defense to that charge.
