A bill to amend title 5, United States Code, with respect to the judicial review of agency interpretations of statutory and regulatory provisions.
Separation of Powers Restoration Act of 2017
This bill replaces the deference given to an agency's interpretation of a statute with a requirement that courts decide all relevant questions of law without giving deference to the agency's interpretation. Thus, this bill overturns Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc.
