A BILL
To provide for the transfer of the decommissioned destroyer ex-U.S.S.
Forrest Sherman (DD-931) to the USS Forrest Sherman DD-931 Foundation,
Inc., a nonprofit organization under the laws of the State of Maryland.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. TRANSFER OF EX-U.S.S. FORREST SHERMAN.
(a) Transfer.--The Secretary of the Navy shall transfer the
decommissioned destroyer ex-U.S.S. Forrest Sherman (DD-931) to the USS
Forrest Sherman DD-931 Foundation, Inc., a nonprofit organization under
the laws of the State of Maryland, upon receipt of a ship donation
application for the transfer of that vessel to that foundation that is
satisfactory to the Secretary.
(b) Costs of Transfer.--The transfer of that vessel under
subsection (a) in accordance with this section shall be made at no cost
to the United States (beyond the cost that the would otherwise be
incurred by the United States for dismantling and recycling of the
vessel).
(c) Applicable Law.--The transfer under this section is subject to
subsection (b) of section 7306 of title 10, United States Code.
Subsection (d) of that section is hereby waived with respect to such
transfer.
(d) Additional Terms and Conditions.--The Secretary may require
such additional terms and conditions in connection with the transfer
under subsection (a) as the Secretary considers appropriate.
