A BILL
To amend section 376 of title 28, United States Code, to allow a period
of open enrollment for certain individuals who are elevated to the
position of chief judge of a district.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. OPEN ENROLLMENT FOR CERTAIN INDIVIDUALS ELEVATED TO POSITION
OF CHIEF JUDGE OF A DISTRICT.
Section 376(a)(1) of title 28, United States Code, is amended--
(1) in subparagraph (F), by striking ``or'' after the
semicolon;
(2) in subparagraph (G), by adding ``or'' after the
semicolon; and
(3) by inserting after subparagraph (G) the following:
``(H) a chief judge of a district;''.
SEC. 2. EFFECTIVE DATE.
(a) Effective Date.--Subject to subsection (b), the amendments made
by section 1 shall take effect on the date of the enactment of this
Act.
(b) Applicability to Certain Individuals.--An individual who became
a chief judge of a district during the period beginning January 1, 2002
and ending on the date of enactment of this Act, but has not made the
notification described under section 376(a)(1) of title 28, United
States Code, may come within the purview of section 376 of that title
if he or she makes such notification not later than 6 months after the
date of enactment of this Act.
