A bill to amend the Age Discrimination in Employment Act of 1967 to require, as a condition of receipt or use of Federal financial assistance, that States waive immunity to suit for certain violations of that Act, and to affirm the availability of certain suits for injunctive relief to ensure compliance with that Act.
Allows such State employees to sue: (1) States for equitable, legal, or other authorized relief; and (2) State officials for injunctive relief, as authorized upon compliance with certain procedures, with the award of costs to the prevailing party.
Applies such State waiver, following enactment of this Act, to conduct on or after the day the State first receives or uses Federal financial assistance for the program or activity. Applies this Act with respect to injunctive relief against a State official to any suit pending on or after enactment.
