Summary

Medical Financial Privacy Protection Act - Amends the Gramm-Leach-Bliley Act to prohibit a financial institution from disclosing to an affiliate or nonaffiliate, without affirmative consent: (1) individually identifiable health information on a consumer; (2) if derived from individually identifiable health information, a list of the consumer's transactions or a description of a consumer's interests, preferences, or other characteristics; (3) an aggregate list of consumers derived from individually identifiable health information; (4) whether a consumer has been denied life or health insurance or any medical test results; or (5) that a consumer has not so consented. Prohibits conditioning provision or the terms of a financial product or service on such consent. Regulates exceptions, redisclosure and reuse of information, information requests by the institution to the consumer, and consumer access to and correction or deletion of information. Requires a separate and specific consent regarding information relating to: (1) mental health or mental condition; (2) human immunodeficiency virus (HIV), acquired immune deficiency syndrome (AIDS), or any other sexually transmitted disease; (3) genetic information; (4) reproductive health services; or (5) substance abuse treatment. Imposes civil liability, allowing individual and class actions.
