A BILL
For the relief of Emma W. Todd.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. ELIGIBILITY TO APPLY FOR A SURVIVOR ANNUITY.
(a) In General.--Notwithstanding clause (iv) of section 4(b)(1)(B)
of the Civil Service Retirement Spouse Equity Act of 1984 (Public Law
98-615; 5 U.S.C. 8341 note), any claim filed by, or on behalf of, Emma
W. Todd, of Norfolk, Virginia, for a survivor annuity under such
section 4(b)(1)(B) as the former spouse of William C. Wynne shall, if
received by the Office of Personnel Management within 12 months after
the date of the enactment of this Act, be treated as if it had been
timely filed.
(b) Prospective Effect.--Any survivor annuity payable as a result
of an application filed in accordance with subsection (a) shall
commence on the first day of the second month beginning after the date
on which such application is received by the Office of Personnel
Management, at the rate that would then be in effect if such
application had been filed on May 7, 1989. No amount shall be payable
as a result of such application for any period before the first day of
such second month.
