To amend the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to exempt certain persons from liability under that Act, and for other purposes.
Environmental Fairness Act - Amends the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to exempt a person from liability under such Act caused by acts or omissions of third parties if the defendant establishes by a preponderance of the evidence that: (1) the actions taken with respect to the hazardous substance occurred before December 11, 1980; (2) the defendant exercised due care and acted in good faith to properly dispose of or recycle the hazardous substance; and (3) such actions were performed in accordance with all applicable Federal and State laws.
Authorizes the United States, in the case of an action to recover costs of removal or remedial action, to recover only the portion of such costs that the person against whom the action is brought is directly responsible for, as established by a preponderance of the evidence.
