IN THE SENATE OF THE UNITED STATES January 23, 1990 Mr. BRYAN (for himself, Mr. REID, and Mr. DASCHLE) introduced the following bill; which was read twice and referred to the Committee on Environment and Public Works A BILL To require that the surplus in the Highway Trust Fund be expended for the Federal-Aid Highway System. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. Notwithstanding any other provision of law, the Secretary of Transportation is authorized and directed to expend out of the Highway Trust Fund for programs and projects authorized under title 23, United States Code, or under any other provision of law, for Federal-aid highways-- (1) in addition to amounts otherwise authorized to be expended-- (A) $3,000,000,000 for the fiscal year in which this Act is enacted, and (B) $3,000,000,000 for each of the 2 succeeding fiscal years, and (2) for the third fiscal year beginning after the fiscal year in which this Act is enacted, and for each succeeding fiscal year, such sums as are deposited into the Highway Trust Fund during that fiscal year. SEC. 2. (a) Section 105 of the Federal-Aid Highway Act of 1987 (13 U.S.C. 104, note) is hereby repealed. (b) Any limitation imposed on the total amount of obligations for Federal-aid highways and highway safety construction programs for any fiscal year that is contained in any law enacted prior to the enactment of this Act shall have no force or effect after the date of enactment of this Act.
