Amends the Public Health Service Act to modify the formula for determining the minimum amount of allotments to States for acquired immune deficiency syndrome (AIDS) public information activities to allow the amount to be equal to the amount received by the State from the Secretary of Health and Human Services, through the Director of the Centers for Disease Control, for FY 1989 for such activities, if those receipts are greater than the amounts under the alternatives specified by existing law.

IN THE HOUSE OF REPRESENTATIVES August 2, 1990 Mrs. KENNELLY (for herself, Mr. GEJDENSON, and Mr. MORRISON of Connecticut) introduced the following bill; which was referred to the Committee on Energy and Commerce A BILL To amend title XXV of the Public Health Service Act to make an adjustment relating to minimum allotments under the program of formula grants established in such title. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. ADJUSTMENT REGARDING MINIMUM ALLOTMENTS FOR FORMULA GRANTS UNDER TITLE XXV OF PUBLIC HEALTH SERVICE ACT. Section 2507(a) of the Public Health Service Act (42 U.S.C. 300ee-17) is amended to read as follows: `(a) MINIMUM ALLOTMENT- Subject to the extent of amounts made available in appropriations Acts, the allotment for a State under section 2501(a) for a fiscal year shall be the greater of-- `(1) the applicable amount specified in subsection (b); `(2) the amount determined in accordance with subsection (c); and `(3) an amount equal to the amount received by the State from the Secretary, acting through the Director of the Centers for Disease Control, for fiscal year 1989 for carrying out public information and education activities with respect to acquired immune deficiency syndrome.'. SEC. 2. EFFECTIVE DATE. The amendment made by section 1 shall take effect October 1, 1990, or upon the date of the enactment of this Act, whichever occurs later.
