Provides that in any case in which a Federal agency is found to be liable under the Comprehensive Environmental Response, Compensation, and Liability Act for a release or threatened release of a hazardous substance at a federally-owned site: (1) the agency shall pay the costs and damages with respect to such site; and (2) no potentially responsible party may be required to pay costs or damages until the agency has paid.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. FEDERAL RESPONSIBILITY AT SUPERFUND SITES. In any case in which a department, agency, or instrumentality of the Federal Government is found to be liable under section 107(a) of Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (42 U.S.C. 9607(a)) for a release or threat of release of a hazardous substance at a site owned or formerly owned by the Federal Government-- (1) the department, agency, or instrumentality shall promptly pay the costs and damages referred to in such section 107(a) with respect to the site; and (2) no other potentially responsible party may be required to pay for any share of the costs or damages with respect to the site until the department, agency, or instrumentality has paid as described in paragraph (1).
