Air Traffic Controller Incentive and Retention Act

Air Traffic Controller Incentive and Retention Act - Increases the premium pay differential for certain air traffic control system employees and other specified employees of the Federal Aviation Administration and the Department of Defense from five to 15 percent of the applicable rate of basic pay. Entitles such employees to Sunday premium pay for work performed on Saturday. Eliminates the age limitation on annuity eligibility under the Civil Service and Federal Employees' Retirement Systems for air traffic controllers with 20 years of service.

A BILL
To amend title 5, United States Code, to improve the ability of the United
States to attract and retain qualified air traffic controllers by offering
controllers premium pay for Saturday work, by raising the controller
differential from 5 to 15 percent, and by eliminating the age limitation on
the voluntary retirement of controllers with 20 years of service, and for
other purposes.
  Be it enacted by the Senate and House of Representatives of the United
  States of America in Congress assembled,
SECTION 1. SHORT TITLE.
  This Act may be cited as the `Air Traffic Controller Incentive and
  Retention Act'.
SEC. 2. INCREASE IN PAY DIFFERENTIAL FOR AIR TRAFFIC CONTROLLERS.
  Section 5546a(a) of title 5, United States Code, is amended in the
  matter preceding paragraph (1) by striking `5 per centum' and inserting
  `15 percent'.
SEC. 3. PREMIUM PAY FOR SATURDAY WORK OF AIR TRAFFIC CONTROLLERS.
  Section 5546a of title 5, United States Code, is amended by adding at the
  end the following new subsection:
  `(g) An employee described in subsection (a) who performs work on Saturday
  shall be entitled to pay under section 5546 of this title as though such
  work were performed on Sunday.'.
SEC. 4. REPEAL OF AGE LIMITATION ON VOLUNTARY RETIREMENT OF AIR TRAFFIC
CONTROLLERS WITH 20 YEARS OF SERVICE.
  (a) CSRS EMPLOYEES- Section 8336(e) of title 5, United States Code, is
  amended by striking `completing 25 years of service as an air traffic
  controller or after becoming 50 years of age and'.
  (b) FERS EMPLOYEES- Section 8412(e) of such title is amended by striking
  `delinquency--' and all that follows through the period at the end and
  inserting `delinquency after completing 20 years of service is entitled
  to an annuity.'.
