To amend the Legal Services Corporation Act to strengthen the provision relating to the payment of attorneys' fees.
Legal Services Corporation Amendments Act of 1989 - Amends the Legal Services Corporation Act to allow a court to award reasonable costs and legal fees to a prevailing defendant (in an action commenced by the Legal Services Corporation or a recipient of Corporation assistance) where: (1) the action was frivolous, unreasonable, or without foundation; (2) the action was pursued to harass the defendant; or (3) the Corporation or recipient maliciously abused legal process. Provides that any such costs and fees shall be paid by the Corporation, by the recipient, or by the attorney, as determined by the Court. (Current law provides for: (1) the awarding of such costs and fees only where the action was pursued to harass the defendant or where the Corporation or recipient abused legal process; and (2) the payment of such costs and fees by the Corporation.)
