Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the `Census Equity Act'. SEC. 2. AMENDMENTS. Section 141 of title 13, United States Code, is amended-- (1) by redesignating subsection (g) as subsection (h); and (2) by inserting after subsection (f) the following: `(g)(1) Effective beginning with the 1990 decennial census of population, in taking any tabulation of total population by States for purposes of the apportionment of Representatives in Congress among the several States, the Secretary shall take appropriate measures to ensure that-- `(A) no member of the armed forces, civilian employee of the Department of Defense, or dependent of any such member or employee, is excluded based on such member or employee being assigned to a post outside the United States; and `(B) any alien not lawfully admitted for permanent residence is not included. `(2) Nothing in this section shall be considered to preclude any decennial census data which is obtained by the Secretary other than in accordance with paragraph (1) of this subsection from being used for any purpose other than the one described in such paragraph.'.
