Dire Emergency Supplemental Appropriations and Transfers, Urgent Supplementals, and Correcting Enrollment Errors Act of 1989 - Title I: Dire Emergency Supplementals and Transfers - (Chapter I is reported in disagreement.) - Chapter II - Appropriates FY 1989 supplemental funds to: (1) the Department of Justice for the Office of Justice Programs; and (2) the Federal Judiciary for payment to the Judicial Officers' Retirement Fund.

Chapter III - Appropriates supplemental FY 1989 funds: (1) to the Department of Defense-Civil for the Department of the Army (through funds transfers); and (2) to the Department of Energy for uranium supply and enrichment activities.

Amends the Water Resources Development Act of 1986 with respect to costs of a feasibility study of Sunset Harbor, California.

Authorizes a land exchange between the Government and the Blue Tee Corporation in connection with land in Madison County, Illinois.

Directs the Secretary of the Army to: (1) construct Highway 415, Segment "C" at the Saylorville Lake, Iowa, Project; and (2) undertake, through the Chief of Engineers, a beach erosion control project at Sims Park, Euclid, Ohio.

Increases the authorized Federal cost in connection with a navigation project at the Bonneville Lock and Dam, Oregon and Washington-Columbia River and tributaries.

Directs the Secretary of the Army, acting through the Chief of Engineers, to undertake preliminary engineering and design for a project at West Fork of Mill Creek Lake, Ohio.

Chapter IV - Appropriates FY 1989 supplemental funds: (1) to the President for the Agency for International Development's Economic Support Fund; and (2) to the Department of State for migration and refugee assistance.

Directs the Secretary of State to instruct the United States representative to the Organization for Economic Cooperation and Development and to the United Nations and its appropriate organizations to seek revisions in the manner in which such organizations report the income and economic activities of nations. Requires such system of accounting to recognize the depletion or degradation of natural resources as a component of economic activities.

Requires the Secretary of the Treasury to instruct the U.S. Executive Director to each multilateral development bank and to the International Monetary Fund to seek revisions in such accounting systems.

Directs the Administrator of the Agency for International Development to incorporate such revisions in evaluations and projections of the economic performance of recipient countries.

Amends the Foreign Operations, Export Financing, and Related Programs Appropriations Act, 1989 to allow assistance to Haiti during FY 1989 to include: (1) sales and donations of certain agricultural commodities; and (2) animal and plant health programs, where the assistance is primarily for the benefit of the United States.

Chapter V - Appropriates supplemental FY 1989 funds to the Departments of Agriculture and of the Interior for emergency firefighting costs on National Forest System and Department of the Interior lands.

Appropriates additional amounts to the Department of the Interior for contingency planning, response, and natural resource damage assessment activities in connection with the oil spill from the tanker Exxon Valdez into Prince William Sound, Alaska. Describes transfer procedures relating to these funds. Amends the Department of the Interior and Related Agencies Appropriations Act, 1989 to include transfer authority for such purposes in connection with Department of the Interior funds.

Directs that revenue received in connection with the Great Plains Gasification Plant currently deposited in the liquidating trust at the First Trust of North Dakota be deposited in the account for the Department of Energy (DOE) alternative fuels production. Transfers a specified amount from this DOE account to the General Fund before FY 1990.

Makes specified amounts available for a third solicitation of clean coal technology demonstration projects to be selected by the DOE not later than January 1, 1990.

Prohibits the executive branch from using any funds to contract out of the DOE any studies of the potential transfer of facilities or functions of Naval Petroleum Reserve Numbered 1 (Elk Hills), in Kern County, California, or Naval Petroleum Reserve Numbered 3 (Teapot Dome), in Wyoming. Prohibits the negotiation of any changes to the Elk Hills unit plan contract with Chevron if the purpose is to prepare divestiture of the Reserve.

Directs the Secretary of the Treasury to make payments of excess FY 1988 timber receipts to the Secretary of Agriculture.

Authorizes the Secretary of the Interior to make restitution payments to eligible Aleuts to compensate for certain losses sustained during World War II.

Provides for a transfer of funds from the National Forest System appropriation account to the Forest Research appropriation account.

Chapter VI - Appropriates supplemental FY 1989 amounts to the Department of Labor for: (1) the Employment and Training Administration for Federal unemployment compensation and trade adjustment assistance; (2) the Occupational Safety and Health Administration, to be available for a grant to California; and (3) departmental management (through funds transfer). Allows the use of funds for State unemployment insurance and employment service operations under the Wagner-Peyser Act to carry out the targeted jobs tax credit program.

Makes supplemental FY 1989 appropriations to the Department of Health and Human Services (HHS) to finance the already required study of manpower training needs with respect to rural health care.

Prohibits specified funds appropriated to the Health Care Financing Administration from being used for forward or multiyear funding.

Repeals an earmark of FY 1989 appropriations for Social Security Administration administrative costs associated with automatic data processing and telecommunications.

Appropriates supplemental FY 1989 amounts to the Department of HHS for payments to States for foster care and adoption assistance.

Makes specified provisions involving impact aid inapplicable to certain local educational agencies.

Affirms certain appropriations as available for Department of Education rehabilitation services and handicapped research. Appropriates supplemental FY 1989 amounts to the Department of Education for: (1) guaranteed student loans; (2) higher education; (3) the Office for Civil Rights; and (4) the Office of Inspector General. Rescinds certain funds made available for expenses of the National Student Loan Data System.

Appropriates supplemental FY 1989 amounts to: (1) the Railroad Retirement Board; (2) the Prescription Drug Payment Review Commission (funds transfer); and (3) the White House Conference on Library and Information Services.

Chapter VII - Appropriates supplemental FY 1989 amounts to the House of Representatives for payment to the widow of the late Bill Nichols, former Representative of Alabama.

Requires the Library of Congress to provide financial management services and support to the United States Capitol Preservation Commission.

Chapter VIII - Limits administrative expenses of the Department of Agriculture's Agricultural Marketing Service.

Appropriates supplemental FY 1989 amounts to the Department of Agriculture for the Agricultural Stabilization and Conservation Service (ASCS) (through funds transfer). Requires the transfer of funds to the Cooperative State Research Service for the Kansas Agricultural Research Experiment Station at Kansas State University for the dissemination of information to farmers on methods of alleviating drought problems and exploring improved water conservation techniques. Amends Federal law to reduce appropriations for the ASCS Conservation Reserve Program.

Amends the Disaster Assistance Act of 1988 to delay, for the 1988 crops of wheat, feed grains, upland cotton, and rice, the date by which producers must refund advanced deficiency payments with respect to certain crops.

Appropriates additional funds for insured operating loans (by transfer from emergency disaster loans). Directs the Secretary of Agriculture immediately to allocate insured farm operating loans to the States to enable them to fund at least the same level of obligations as in FY 1988.

Reduces FY 1989 amounts appropriated to the Agricultural Credit Insurance Fund of the Farmers Home Administration for water development, use, and conservation loans and for Indian tribal land acquisition loans.

Revises amounts available in the Rural Housing Insurance Fund for newly constructed units covered under rural rental assistance agreements.

Makes supplemental FY 1989 appropriations for: (1) the Rural Development Insurance Fund for insured water and sewer facility loans; and (2) water and waste disposal grants;

Directs the ASCS to reimburse the Soil Conservation Service for certain services provided in connection with the conservation reserve program.

Reduces the amount in loans that may be insured under the Agricultural Credit Insurance Fund in connection with watershed and flood prevention operations and resource conservation and development.

Makes supplemental FY 1989 appropriations to the Food and Nutrition Service to operate the food stamp program.

Makes supplemental appropriations to the Food and Drug Administration for orphan drug grants and contracts.

Chapter IX - Appropriates additional FY 1989 amounts to the Department of Transportation (DOT) for payments to air carriers. Prohibits after September 30, 1989, the payment of any per passenger subsidy exceeding $300 for service to or from any essential air service point in the contiguous United States.

Prohibits the withholding of DOT appropriations from any State or local grant recipients for any reason related to their adoption of a policy that prohibits procurement of products manufactured or fabricated in the Republic of South Africa.

Prescribes treatment of amounts to reimburse Coast Guard operating expenses in connection with the Exxon Valdez oil spill.

Makes certain funds available to the Coast Guard for equipment to provide vessel traffic management information in the New York Harbor area. Requires: (1) the Coast Guard to establish such an information system by a specified deadline; and (2) the Secretary of Transportation, by another deadline, to initiate a rulemaking to determine which vessel classes must participate in such a system.

Makes certain funds available to the Coast Guard for responding to any oil spill.

Directs the Federal Aviation Administrator to initiate action within 30 days of enactment to require air carriers to use explosive detection equipment at airports to ensure air passenger safety.

Prescribes funding provisions with respect to phase two of the construction of a bridge across the Mississippi River at Dubuque, Iowa, under the discretionary bridge program.

Chapter X - Appropriates supplemental FY 1989 amounts to the Department of the Treasury for international affairs, through fund transfers.

Chapter XI - Appropriates FY 1989 supplemental funds to the Department of Veterans Affairs for: (1) the Veterans Benefits Administration; (2) the Veterans Health Services and Research Administration (partly through funds transfer); and (3) departmental administration. Repeals language in the Department of Housing and Urban Development-Independent Agencies Appropriations Act, 1989 that earmarked funds for Veterans Benefits Administration expenses.

Exempts certain funds recaptured in connection with the moderate rehabilitation program (section 8 housing) from rescission, retaining them for annual contributions for assisted housing projects.

Appropriates FY 1989 supplemental amounts for payments to the Department of Housing and Urban Development for: (1) the operation of low-income housing projects (including grants for use in eliminating drug-related crime in public housing projects); and (2) management and administration expenses. Effects both appropriations through funds transfers.

Amends the United States Housing Act of 1937 to exempt expressly the City of New York from certain requirements in connection with rental rehabilitation and development grants. (Under current law, the exemption covers New York State.)

Appropriates supplemental FY 1989 funds to: (1) the Court of Veterans Appeals, including provisions to govern appointment of new court employees; (2) the Environmental Protection Agency (EPA); and (3) the Federal Emergency Management Agency for the emergency food and shelter program; (4) the National Science Foundation; and (5) the National Aeronautics and Space Administration. Rescinds a specified amount of funds for the Hazardous Substance Superfund administered by the EPA.

Chapter XII - Appropriates supplemental FY 1989 amounts to the District of Columbia (District) for inaugural expenses, through funds transfer. Appropriates specified amounts (minus certain rescissions) to the District for: (1) governmental direction and support; (2) economic development and regulation; and (3) public works. Rescinds specified funds for: (1) repayments of loans and interest; (2) personal services adjustments; (3) energy programs; and (4) equipment.

Appropriates supplemental amounts to the District for: (1) public safety and justice, (minus a certain rescission), with earmarks for overtime expenses of the Metropolitan Police Department and the Superior Court; (2) the public education system (minus certain rescissions); (3) human support services (minus a certain rescission), with earmarks for employees' disability compensation and for food for the homeless; (4) the Washington Convention Center Fund; (5) repayment of the District's General Fund deficit, together with a requirement that any revenue resulting from a specified lawsuit be applied solely to this account; (6) short-term borrowings; and (7) capital outlay (minus a certain rescission), with earmarks for a feasibility study and site acquisition associated with construction of a jail.

Directs the District's Mayor to reduce the number of personnel above the DS-10 level.

Appropriates supplemental FY 1989 amounts to the Water and Sewer Enterprise Fund to compensate individuals in accordance with the Water Main Break Fund Emergency Act of 1988.

Forgives a specified portion of the fourth quarter indebtedness incurred by the District of Columbia government.

Directs the District government to begin construction of a required correctional facility within 30 days of enactment.

Title II: Urgent Supplemental Appropriations - Chapter I - Appropriates supplemental FY 1989 amounts to: (1) the Department of Commerce for the National Oceanic and Atmospheric Administration; and (2) the Department of Justice for legal activities and for the Office of Justice Programs, (minus a certain rescission), with an earmark for a grant to the University of South Carolina to study the causes and effects of the increasingly disproportionate use of illegal drugs in the black community.

Rescinds a specified amount from the Assets Forfeiture Fund and the Office of Justice Programs.

Authorizes the President to effect certain fund transfers to assist in financing the Department of State contributions to international peacekeeping activities. Prescribes conditions in connection with such transfers.

Appropriates supplemental FY 1989 amounts to the Department of Transportation for the Maritime Administration's Federal Ship Financing Fund.

Authorizes the Secretary of Transportation to issue a certificate of documentation for specified vessels.

Amends Federal law to authorize the Federal Communications Commission to expend the funds remaining from the sale of the Fort Lauderdale, Florida, Monitoring Station, for FY 1989 salaries and expenses instead of returning the used funds to the Treasury's General Fund.

Makes FY 1989 funds already appropriated to the Commission for the Study of International Migration and Cooperative Economic Development and the Commission on Agricultural Workers available until expended.

Authorizes the Director of the Administrative Office of the United States Courts, upon completing specified procedures, to transfer unobligated balances of certain accounts to any appropriation account of the Judiciary.

Authorizes the use of United States Information Agency funds currently available for television broadcasting to Cuba for aircraft to house and operate necessary broadcasting equipment.

Revises eligibility requirements for magistrate vacancies in district courts.

Prohibits the use of any funds to relocate, reorganize or consolidate any office, agency, function, facility, station, activity, or other entity under the jurisdiction of the Department of Justice and the Small Business Administration.

Chapter II - Increases the amount available in the Department of Defense Appropriations Act, 1989 for Department of Defense-Military morale, welfare, and recreation activities. Makes these funds available solely to cover costs related to underestimates of expenses of transporting exchange merchandise to overseas locations and to compensate for adverse changes in foreign currency exchange rates.

Repeals provisions of the Department of Defense Appropriations Act, 1989 that prohibit the use of appropriations to alter the command structure for military forces in Alaska.

Exempts from appropriations limitations on contributions to the Department of Defense (DOD) Education Benefits Fund certain members who enlist in the armed services on or after July 1, 1989, under a 15-month program to test the cost-effectiveness of special recruiting incentives.

Adds high mobility multipurpose wheeled vehicles to the list of items eligible for multiyear DOD procurement contracts for FY 1989.

Earmarks an amount for procurement for the Extended Cold Weather Clothing System, unless specified conditions are met.

Authorizes the Secretary of Defense to conduct a test program to adjust pay rates for civilian employees in certain health care occupations.

Increases the number of Executive Schedule positions permitted in the DOD.

Directs the Secretary of Defense, with funds already available, to accommodate repair of real property, aircraft, and other DOD assets damaged during the storm at Fort Hood, Texas, on May 13, 1989.

Chapter III - Prohibits the use of Department of the Interior funds to place the Al Capone House in Chicago, Illinois, on the National Register of Historic Places.

Authorizes the King Center and the National Park Service to locate an additional parking site for the Martin Luther King National Historic Site.

Chapter IV - Appropriates FY 1989 supplemental amounts to the Department of Transportation (DOT) for the Federal Aviation Administration's aircraft purchase loan guarantee program.

Increases the amount of FY 1989 DOT appropriations for expenses of advisory committees.

Authorizes the New York State Bridge Authority to collect tolls on the Newburgh-Beacon Bridge and to use the revenue for prescribed purposes.

Increases permissible funds transfers in connection with certain DOT appropriations.

Chapter V - Amends the Treasury Department Appropriations Act, 1989 to authorize the U.S. Customs Service to transfer two E2C aircraft to the U.S. Coast Guard. Makes FY 1989 appropriations to the Department of the Treasury for the U.S. Secret Service for construction of barriers at the south end of the White House available until expended.

Increases permissible funds transfers within the Department of the Treasury.

Appropriates supplemental FY 1989 amounts to the Executive Office of the President for grants to the Popular Democratic Party, the New Progressive Party, and the Puerto Rican Independence Party of the Commonwealth of Puerto Rico. Prescribes conditions to govern the grants, including a required audit.

Makes available until expended amounts previously made available to the Office of Personnel Management to implement the recordkeeping system of the Federal Employees' Retirement System.

Directs the Administrator of General Services to transfer to the administrative jurisdiction of the Holocaust Memorial Council, without consideration, the Auditors West Building (annex 3) at Raoul Wallenberg Place and Independence Avenue, S.W., in Washington, D.C. Requires pre-transfer agreement by the Council to make necessary repairs and alterations in accordance with a detailed plan.

Appropriates supplemental FY 1989 amounts to the Federal Election Commission to be derived through a funds transfer.

Authorizes the General Services Administration to purchase with funds in the Federal Buildings Fund furniture and equipment necessary for the National Oceanic and Atmospheric Administration to relocate to Silver Spring, Maryland. Requires NOAA to reimburse the GSA over a two-year period.

Chapter VI - Requires that the costs of Department of Veterans Affairs (DVA) external contract audits be charged to the DVA Construction accounts.

Authorizes the Secretary of Housing and Urban Development (HUD) to make certain funds available as subsidy amounts for specified types of handicapped housing projects.

Appropriates FY 1989 supplemental amounts to implement the HUD Secretary's authority to provide interest reductions and rental assistance.

Makes certain funds available to the Hawaii State Department of Hawaiian Home Lands for a special project involving infrastructure development of these lands, notwithstanding restrictions on alienation.

Increases the FY 1989 restriction on program development and management costs of the National Science Foundation.

Revises the limitation on the use of appropriations to pay for travel costs of Federal employees or officers between home and work.

Title III: Technical Enrollment Corrections - Makes technical enrollment corrections in a number of FY 1989 appropriations Acts. Includes as a correction the addition of a prohibition on the use of appropriations under the Foreign Operations Export Financing, and Related Programs Appropriations Act, 1989 to fund programs to assist in solving the Japanese beetle problem in the Azores. Expresses the sense of the Congress that the Department of Defense created the problem and should fund its resolution.

Title IV: General Provisions - Prohibits obligation beyond FY 1989 of any funds appropriated in this Act.

Makes FY 1989 appropriations available for the interagency funding of national security and emergency preparedness telecommunications initiatives that benefit multiple Federal departments, agencies, or entities.

Places a condition on the use of funds to enforce the Alcoholic Beverage Labeling Act of 1988 with respect to a warning on drinking and pregnancy and drinking and driving.

Directs the Secretary of HUD to: (1) review eviction procedures of jurisdictions that have a Public Housing Authority to determine whether they meet Federal due process standards; (2) issue waivers from Federal procedures to jurisdictions in compliance; and (3) report results to the Congress.

Expresses the sense of the Senate that the President should not appoint a new Administrator of the Panama Canal Commission unless and until the ruling government in Panama is democratically elected.

Expresses the sense of the Senate that the Bankruptcy Court and all involved parties should facilitate the prompt and safe restoration of Eastern Airlines to full operations through all appropriate action.

Makes it the responsibility of the Undersecretary of State for Coordinating Security Assistance Policy to: (1) coordinate U.S. diplomatic efforts to obtain the agreement of all appropriate countries to a missile technology control regime encompassing chemical, biological, and nuclear capable missiles; and (2) coordinate policies within the U.S. government on strategies for restricting the export of components of missiles which are capable of carrying nuclear, chemical, or biological weapons. Requires the Secretary of State to report to the Speaker of the House and the President pro tempore of the Senate on a strategy for dealing with the missile proliferation issue.

Suspends the U.S. obligation to repurchase Stinger antiaircraft missiles from Bahrain until October 31, 1989.

Amends the Social Security Act to waive civil service hiring procedures for the National Commission on Children and to permit the Commission to hire consultants.

Expresses the sense of the Senate that the Secretary of Transportation should review the potential impact of highly leveraged acquisitions of control of U.S. air carriers.

Authorizes the Secretary of Agriculture to use certain authority to stabilize the apple market and to satisfy the requests of recipient agencies.
