Prohibits any employer from taking adverse action against any employee or applicant based on the results of a drug test conducted by a laboratory which fails to meet the requirements of this Act.
Requires any laboratory which conducts drug testing to: (1) meet the mandatory requirements established by the Secretary of Health and Human Services; (2) require a confirmatory test when an initial screening is positive; and (3) provide guidelines to employers on the collection and handling of specimens.
Provides civil penalties for violations of this Act.
