Authorizes appropriations for FY 1992 through 1996 out of the Highway Account of the Highway Trust Fund for: (1) interstate highway construction, resurfacing, restoring, rehabilitation, and reconstruction; (2) the Federal-aid primary system; (3) the Federal-aid secondary system; (4) the Federal-aid urban system; and (5) bridge construction and rehabilitation projects.
Directs the Secretary of Transportation to apportion sums authorized by this Act among the States in the ratio of each State's apportionments for Federal-aid highway programs to the total apportionments for all States during FY 1991. Makes specified percentages of unobligated funds for FY 1992 available in FY 1992 through 1996.
Specifies that there shall be no obligation limitation for Federal-aid highway and highway safety construction programs for such fiscal years except as established in this Act.

IN THE SENATE OF THE UNITED STATES March 5 (legislative day, FEBRUARY 6), 1991 Mr. BRYAN (for himself and Mr. REID) introduced the following bill; which was read twice and referred to the Committee on Environment and Public Works A BILL To require that the surplus in the Highway Account of the Highway Trust Fund be available for expenditure, and for other purposes. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. AUTHORIZATION OF APPROPRIATIONS. There is authorized to be appropriated out of the Highway Account of the Highway Trust Fund for each of the fiscal years 1992, 1993, 1994, 1995, and 1996 for Interstate construction; Interstate resurfacing, restoring, rehabilitating and reconstruction; the Federal-aid primary system; the Federal-aid secondary system; the Federal-aid urban system; and bridge replacement and rehabilitating under title 23, United States Code, the maximum amount which, when added to other authorizations to be apportioned from the Highway Account of the Highway Trust Fund, may be apportioned under the provisions of section 9503(d) of the Internal Revenue Code of 1986 SEC. 2. APPORTIONMENT. On October 1 of each of the fiscal years 1992, 1993, 1994, 1995, and 1996, or as soon thereafter as is practicable, the Secretary of Transportation shall apportion the sums authorized to be appropriated by this Act, among the States, as defined in section 101 of title 23, United States Code, in the ratio in which each State's apportionments for Federal-aid highway programs during the fiscal year 1991 bears to the total apportionments for all States during the fiscal year 1991. SEC. 3. AVAILABILITY. The sums apportioned under this Act shall be available for obligation and expenditure under the provisions of title 23, United States Code, when apportioned, for Interstate, Federal-aid primary, Federal-aid secondary, Federal-aid urban and bridge projects and shall be available for obligation in a State for the fiscal year of apportionment and for four additional fiscal years; Provided, That sums remaining unobligated at the end of the period shall lapse: And provided further, That of the sums apportioned under this Act during fiscal year 1992, and any unobligated balances made available to the States by this Act in fiscal year 1992, 20 per centum shall be available for obligation in fiscal year 1992, 40 per centum shall be available for obligation in fiscal year 1993, 60 per centum shall be available for obligation in fiscal year 1994, 80 per centum shall be available for obligation in fiscal year 1995, and 100 per centum shall be available for obligation in fiscal year 1996. SEC. 4. OBLIGATION CEILING. There shall be no obligation limitation for Federal-aid highway and highway safety construction programs for the fiscal years 1992, 1993, 1994, 1995, and 1996 except as established in this Act.
