Declares that each standing committee of the House of Representatives shall, not later than September 17, 1990, submit to the House Budget Committee alternatives to the report of the Director of the Office of Management and Budget under the Balanced Budget and Emergency Deficit Control Act of 1985 (Gramm-Rudman-Hollings Act), insofar as such report affects laws within the jurisdiction of the committee.
Requires the Budget Committee, not later than September 20, 1990, to report a resolution containing instructions to committees sufficient to achieve the total level of deficit reduction contained in the Director's report for FY 1991. Provides that such instructions shall require that each committee (and each subcommittee of the Committee on Appropriations) achieve the same level of deficit reduction with respect to programs under its jurisdiction as would have been saved under the Director's report.
Requires committees to submit recommendations to the Budget Committee by September 25, 1991, sufficient to meet deficit reductions.
Requires the Budget Committee to promptly report a reconciliation bill carrying out such recommendations. Authorizes the Budget Committee to include legislative language within the jurisdiction of any noncomplying committee. Requires such reconciliation bill to include a provision which states that if it is enacted on or before October 15, 1990, then the President's sequestration order for FY 1991 is null and void.

IN THE HOUSE OF REPRESENTATIVES September 11, 1990 Mr. MCCANDLESS submitted the following resolution; which was referred to the Committee on Rules RESOLUTION To facilitate compliance with congressional intent expressed in the Balanced Budget and Emergency Deficit Control Act of 1985 with respect to fiscal year 1991. Resolved, SECTION 1. CONGRESSIONAL COMPLIANCE. (a) PURPOSE- The purpose of this resolution is to facilitate compliance with congressional intent expressed in the Balanced Budget and Emergency Deficit Control Act of 1985 with respect to fiscal year 1991. (b) CONGRESSIONAL RESPONSE TO OMB REPORT- (1) REPORTING OF RESOLUTIONS AND RECONCILIATION BILLS IN THE HOUSE OF REPRESENTATIVES- (A) COMMITTEE ACTION- Not later than September 17, 1990, each standing committee of the House of Representatives shall submit to the Committee on the Budget information of the type described in section 301(d) of the Congressional Budget Act of 1974 with respect to alternatives to the August 20, 1990, report of the Directors of Office of Management and Budget for fiscal year 1991 issued under section 251(a)(2) of the Balanced Budget and Emergency Deficit Control Act for fiscal year 1991 insofar as such report affects laws within the jurisdiction of the committee. (B) INITIAL BUDGET COMMITTEE ACTION- Not later than September 20, 1990, the Commission on the Budget of the House of Representatives shall report a resolution. The resolution shall contain instructions to committees of the House of the types referred to in section 310(a) of the Congressional Budget Act of 1974, sufficient to achieve the total level of deficit reduction contained in the report of the Directors issued under section 251(a)(2) of the Balanced Budget and Emergency Deficit Control Act of 1985 for fiscal year 1991. Such instructions shall also require that each committee achieve the same level of deficit reduction with respect to programs under its jurisdiction as would have been saved under such report, and in the case of the Committee on Appropriations shall require that each subcommittee thereof achieve the same level of deficit reduction with respect to programs under its jurisdiction as would have been saved under such report. (C) RESPONSE OF COMMITTEES- Committees instructed pursuant to subparagraph (B) shall submit their responses to the Committee on the Budget not later than September 25, 1991. A committee shall be considered to have complied with all instructions to it pursuant to a resolution adopted under subparagraph (B) if it has made recommendations with respect to matters within its jurisdiction which would result in a reduction in the deficit at least equal to the total reduction directed by such instructions, and, in the case of the Committee on Appropriations, its reductions are in compliance with the last sentence of subparagraph (B) with respect to each of its subcommittees. (D) BUDGET COMMITTEE ACTION- Upon receipt of the recommendations received in response to a resolution referred to in subparagraph (B), the Committee on the Budget shall promptly report a reconciliation bill carrying out all such recommendations without any substantive revision. In the event that a committee instructed in a resolution referred to in subparagraph (B) fails to submit any recommendation in response to such instructions, the Committee on the Budget shall include in the reconciliation bill reported pursuant to this subparagraph legislative language within the jurisdiction of the noncomplying committee to achieve the amount of deficit reduction directed in such instructions. The Committee on the Budget shall also include in such reconciliation bill a provision which states that if such bill is enacted on or before October 15, 1990, the Presidential order issued under section 252(b) of the Emergency Deficit Control Act of 1985 with respect to fiscal year 1991 shall be null and void; and for purposes of such Act and the Congressional Budget Act of 1974, the reconciliation bill shall take the place of such order. (2) PROCEDURES- (A) CONSIDERATION- When the Committee on the Budget of the House of Representatives has reported a resolution or reconciliation bill under paragraph (1), it is in order at any time after the first day (excluding Saturdays, Sundays, and legal holidays) following the day on which the report upon such resolution by the Committee on the Budget has been available to Members of the House to move to proceed to the consideration of the resolution or bill. The motion is highly privileged and is not debatable. An amendment to the motion is not in order, and it is not in order to move to reconsider the vote by which the motion is agreed to or disagreed to. (B) LIMIT ON DEBATE- General debate on a resolution or reconciliation bill reported under paragraph (1) in the House of Representatives shall be limited to not more than 5 hours, which shall be divided equally between the majority and minority parties. A motion further to limit debate is not debatable. A motion to recommit the resolution or bill is not in order, and it is not in order to move to reconsider the vote by which the resolution or bill is agreed to or disagreed to. (C) LIMITATION ON AMENDMENTS- No amendments shall be in order in the House of Representatives to any resolution or reconciliation bill reported under paragraph (1), except (in the case of the reconciliation bill) one amendment (in the nature of a substitute) if offered by a member of the minority party who is opposed to the bill. (D) PREVIOUS QUESTION- After the Committee rises and reports the resolution or reconciliation bill reported under paragraph (1) back to the House, the previous question shall be considered as ordered on the resolution or reconciliation bill and any amendments thereto to final passage without intervening motion. (E) DEBATE ON CONFERENCE REPORT- Debate in the House of Representatives on the conference report on any resolution or reconciliation bill reported under paragraph (1) shall be limited to not more than 5 hours, which shall be divided equally between the majority and minority parties. A motion further to limit debate is not debatable. A motion to recommit the conference report is not in order, and it is not in order to move to reconsider the vote by which the conference report is agreed to or disagreed to. (F) FURTHER LIMITATION ON DEBATE- Appeals from decisions of the Chair relating to the application of the Rules of the House of Representatives to the procedure relating to any resolution or reconciliation bill reported under paragraph (1) shall be decided without debate.
