IN THE HOUSE OF REPRESENTATIVES September 17, 1990 Mr. BUSTAMANTE (for himself and Mr. LEATH) introduced the following bill; which was referred to the Committee on Education and Labor A BILL To create an interagency task force to review programs relating to the education of students in certain school districts receiving assistance under the Impact Aid Act. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. ESTABLISHMENT OF INTERAGENCY TASK FORCE. There is established a task force to be known as the Task Force on the Education of Federally-Connected Dependents. SEC. 2. DUTIES OF THE TASK FORCE. The duties of the Task Force shall be to review and evaluate the administration and operation of the impact aid program, as it relates to Federally-connected children under the Act of September 30, 1950 (commonly known as the Impact Aid Act), including-- (1) the present funding of impact aid under that Act, with emphasis on school districts which have a Federally-connected child average daily attendance of at least 20 percent of the total student enrollment; (2) a review of the operation of various programs, such as the Impact Aid Act, critical to the education of Federally-connected children which receive funds from impact aid and whether such programs need to be modified; (3) a determination of whether military dependents attending public schools on military installations in the United States receive educational opportunities equal to that of nonmilitary dependent students in comparable school districts; (4) a determination of whether children residing on Indian land receive educational opportunities of the same quality as that of students in other school districts in the State or States in which the land is located and those funded by the Bureau of Indian Affairs; and (5) an examination of the need for the establishment of priorities in the funding of impact aid programs affecting Federally-affected children. SEC. 3. MEMBERSHIP OF THE TASK FORCE. The Task Force shall be composed of-- (1) the Assistant Secretary of Defense for Force Management and Personnel or the Assistant Secretary's designee; (2) the Deputy Assistant Secretary of Defense for Family Support, Education, and Safety or the Deputy Assistant Secretary's designee; (3) the Department of Defense Director for Department of Defense Schools or the Director's designee; (4) the Department of Education Director of Dependents Support Policy or the Director's designee; (5) the Assistant Secretary of Education for Elementary and Secondary Education or the Assistant Secretary's designee; (6) the Director for Impact Aid Programs or the Director's designee; (7) the Assistant Secretary of the Interior for Indian Affairs or the Assistant Secretary's designee; (8) the Deputy to the Assistant Secretary of the Interior for Indian Education Programs or the Deputy's designee; (9) the Department of Education Director for Indian Education Programs or the Director's designee; and (10) representatives of other governmental, nonprofit, and business entities as considered appropriate by the Secretary of Education, the Secretary of Housing and Urban Development, the Secretary of the Interior, or the Secretary of Defense. SEC. 4. REPORTS. The Task Force shall submit reports-- (1) to the Secretary of Defense, the Secretary of Housing and Urban Development, the Secretary of the Interior, and the Secretary of Education as often as considered necessary by the Task Force; and (2) to the Congress, not later than 9 months after the date of the enactment of this Act and once a year each year thereafter until the termination of the Task Force; containing the findings and recommendations relating to the review and evaluation conducted pursuant to section 2. SEC. 5. ADMINISTRATION AND TERMINATION OF TASK FORCE. (a) IN GENERAL- Part D of the General Education Provisions Act (20 U.S.C. 1233-1233h; relating to the administration of education advisory councils) shall apply to the Task Force. (b) STAFF OF TASK FORCE- For the purposes of the appointment and pay of personnel of the Task Force, subsections (a) and (d) of section 445 of the General Education Provisions Act (20 U.S.C. 1233d (a) and (d)) shall apply to the Task Force. (c) TERMINATION- The Task Force shall terminate 5 years after the date of the enactment of this Act. SEC. 6. DEFINITIONS. As used in this Act-- (1) the terms `Federally-connected child' and `Federally-connected children' mean children who are described in subsection (a) or (b) of section 3 of the Act of September 30, 1950 (20 U.S.C. 238 (a) or (b)); (2) the term `impact aid' means payments made under the Act of September 30, 1950; (3) the term `Indian land' means land that is described in section 403(1)(A) of the Act of September 30, 1950 (20 U.S.C. 244(1)(A)); (4) the term `military dependent' means a dependent as defined in paragraph (1) of section 1414 of the Defense Dependents' Education Act of 1978 (20 U.S.C. 932(1)); (5) the term `Task Force' means the Task Force on the Education of Federally-Connected Dependents established under section 1 of this Act; and (6) the term `United States' has the meaning given that term in paragraph (4) of section 1414 of the Defense Dependents' Education Act of 1978 (20 U.S.C. 932(4)).
