Authorizes the Secretary of Transportation to assist in the construction of an Appalachian highway system and local access roads serving the Appalachian region. Authorizes appropriations to the Secretary for such assistance out of the Highway Trust Fund. Exempts such assistance from any Federal-aid highway and highway safety construction program ceilings. Limits to 80 percent the Federal share of the cost of any construction project under this Act. Provides an apportionment formula to be followed by the Secretary in making funds available to States for such assistance.
Requires the Appalachian Regional Commission to submit to the Secretary a list of estimated project costs.
States that, beginning with FY 1993, projects eligible for assistance under this Act shall be eligible for funds available under law applicable to the construction and maintenance of Federal-aid primary highways.

IN THE HOUSE OF REPRESENTATIVES June 21, 1990 Mr. STAGGERS introduced the following bill; which was referred to the Committee on Public Works and Transportation A BILL To authorize appropriations for the Appalachian highway system and local access roads serving the Appalachian region, and for other purposes. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. APPALACHIAN HIGHWAY SYSTEM ASSISTANCE PROGRAM. (a) GENERAL AUTHORITY- Notwithstanding any other provision of law, the Secretary of Transportation is authorized to assist in the construction of an Appalachian highway system and local access roads serving the Appalachian region. (b) AUTHORIZATION OF APPROPRIATION- (1) FROM HIGHWAY TRUST FUND- There are authorized to be appropriated to the Secretary of Transportation to carry out this section, out of the Highway Trust Fund (other than the Mass Transit Account), $2,360,000,000 for fiscal year 1992. (2) PERIOD OF AVAILABILITY- Funds appropriated pursuant to paragraph (1) shall remain available until expended. (c) APPLICABILITY OF OBLIGATION CEILINGS- Obligation limitations for Federal-aid highway and highway safety construction programs shall not apply to obligations made under this section, except where the provision of law establishing the limitation specifically amends or limits the applicability of this subsection. (d) MAXIMUM FEDERAL SHARE- Federal assistance to any construction project under this section shall not exceed 80 percent of the costs of such project. (e) APPORTIONMENT OF FUNDS- (1) FORMULA- The Secretary of Transportation shall apportion funds made available under this section to each State of the Appalachian region on the basis of a percentage equal to the percentage that that State's estimated project costs bear to the total estimated project costs for all States of the Appalachian region. (2) ESTIMATES FROM APPALACHIAN REGIONAL COMMISSION- The Appalachian Regional Commission shall submit to the Secretary of Transportation a list of the estimated project costs, calculated as of September 30, 1990. (f) DEFINITIONS- For purposes of this section-- (1) the term `Appalachian region' has the meaning such term has under section 403 of the Appalachian Regional Development Act of 1965; and (2) the term `estimated project costs' means the costs of highway projects for which Federal assistance is authorized by this section. SEC. 2. ELIGIBILITY FOR FEDERAL-AID PRIMARY HIGHWAY ASSISTANCE. Beginning with fiscal year 1993, projects eligible for assistance under section 1 shall be eligible for funds available under laws applicable to construction and maintenance of Federal-aid primary highways and subject to the same terms and conditions required by such laws.
