Directs the Secretary of the Navy to: (1) permit and facilitate the construction in U.S. shipyards and related facilities of combatant vessels and components for U.S. allies, subject to the required safeguarding of sensitive warship technology; and (2) ensure that no effort is made by the Department of the Navy to inhibit, delay, or halt the provision to such an ally of any U.S. naval system approved for export to a foreign nation.
Authorizes the President to restrict such activities of the Secretary in the interest of national security. Requires the President to notify the Congress within 30 days if he exercises such restriction.

IN THE HOUSE OF REPRESENTATIVES April 4, 1990 Mr. GEJDENSON introduced the following bill; which was referred to the Committee on Armed Services A BILL To amend title 10, United States Code, to require the Secretary of the Navy to permit and facilitate the construction in United States shipyards and related facilities of combatant vessels and components for allies of the United States. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. CONSTRUCTION IN UNITED STATES SHIPYARDS AND FACILITIES OF COMBATANT VESSELS AND COMPONENTS FOR UNITED STATES ALLIES. (a) PROMOTION OF EFFORTS TO BUILD NAVAL VESSELS FOR ALLIED NATIONS- (1) Chapter 633 of title 10, United States Code, is amended by inserting after section 7299a the following new section: `Sec. 7300. Construction in United States shipyards and related facilities of combatant vessels and components for United States allies `(a) DUTY OF THE SECRETARY- The Secretary of the Navy shall take such steps as necessary-- `(1) to permit, and facilitate the efforts of, United States shipyards and related facilities to construct combatant vessels and components for nations allied with the United States, subject to the requirement to safeguard sensitive warship technology; and `(2) to ensure that no effort is made by any element of the Department of the Navy to inhibit, delay, or halt the provision of any United States naval system to a nation allied with the United States if that system is approved for export to a foreign nation. `(b) RESTRICTIONS- (1) The President may restrict the activities of the Secretary of the Navy under subsection (a) with regard to a shipyard, related facility, combatant naval vessel, or naval system if the President determines that the restriction is necessary for national security reasons. `(2) The President shall notify the Congress each time the President exercises the authority provided by paragraph (1) not later than 30 days after the date on which the President exercises that authority. `(c) SENSITIVE WARSHIP TECHNOLOGY DEFINED- In this section, the term `sensitive warship technology' means technology relating to the design or construction of a combatant naval vessel or component that is determined by the Secretary of Defense to be vital to United States security.'. (2) The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 7299a the following new item: `7300. Construction in United States shipyards and related facilities of combatant vessels and components for United States allies.'. (b) CONFORMING AMENDMENT- (1) Section 1455(a) of the Department of Defense Authorization Act, 1986 (10 U.S.C. 7291 note) is amended to read as follows: `(a) IN GENERAL- If opportunities arise to construct combatant vessels (including diesel submarines) outside the United States in a shipyard of a friendly foreign nation, with some or all of the costs provided by United States funds, the Secretary of the Navy shall take such steps as necessary-- `(1) to encourage United States firms to participate in such construction to the maximum extent possible, subject to the requirement to safeguard sensitive warship technology; and `(2) to ensure, whenever practicable, that at least 51 percent of the dollar value of that construction is provided by United States firms.'. (2) The title of that section is amended to read as follows: SEC. `1455. ENCOURAGEMENT OF UNITED STATES FIRMS PARTICIPATION IN THE CONSTRUCTION OF COMBATANT VESSELS IN ALLIED NATIONS.'.
