Indiana Dunes National Lakeshore Expansion Act of 1989 - Amends Federal law to modify the boundaries of the Indiana Dunes National Lakeshore in Indiana. Requires the Secretary of the Interior to acquire State and local roads and road rights-of-way under certain circumstances.

IN THE HOUSE OF REPRESENTATIVES November 7, 1989 Mr. JONTZ introduced the following bill; which was referred to the Committee on Interior and Insular Affairs A BILL To modify the boundaries of the Indiana Dunes National Lakeshore, and for other purposes. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the `Indiana Dunes National Lakeshore Expansion Act of 1989'. SEC. 2. REFERENCE. Whenever in this Act a section or other provision is amended or repealed, such amendment or repeal shall be considered to be made to that section or other provision of the Act entitled `An Act to provide for the establishment of the Indiana Dunes National Lakeshore, and for other purposes', approved November 5, 1966 (16 U.S.C. 460u et seq.). SEC. 3. BOUNDARIES. Section 1 of the Act (16 U.S.C. 460u) is amended by striking `October 1986, and numbered 626-80, 033-B,' and inserting ` 1989, and numbered ,'. SEC. 4. RIGHTS-OF-WAYS. (a) ROADS- Section 2(a) of the Act (16 U.S.C. 460u-2(a)) is amended by adding at the end the following: `With the consent of the owner thereof, the Secretary is authorized to acquire by donation, purchase with donated or appropriated funds, or exchange, lands or interests therein for roads and road rights-of-way which are owned by a State or a political subdivision thereof when the Secretary has determined that such roads or road rights-of-way, developed or undeveloped, are no longer necessary for access by the State or the political subdivision or the residents thereof or the continuation of any such road or right-of-way interferes with the purposes for which the lakeshore was established.'. (b) UTILITIES- Section 10 of the Act (16 U.S.C. 460u-10) is amended by adding at the end the following: `The Secretary is authorized to acquire, by donation, purchase with donated or appropriated funds or otherwise, existing rights-of-way or easements within the lakeshore when the Secretary has determined that such rights-of-way or easements are no longer necessary for the provision of utility services.'. SEC. 5. RIVER CORRIDORS AND WETLANDS. Section 2 of the Act (16 U.S.C. 460u-2) is amended by adding at the end the following: `(c)(1) The areas identified as Unit VIII-A, `Little Calumet River Corridor' and VIII-B `Salt Creek Corridor on the map referred to in section 1 dated , 19 , and numbered ' shall include, at a minimum, all wetland and riverine areas identified by the United States Fish and Wildlife Service on National Wetlands Inventory maps for the areas. Unit VIII-A shall include the segment of the Little Calumet River from the Indiana Dunes National Lakeshore's Heron Rookery (Unit IV-A) to the existing boundary of the Indiana Dunes National Lakeshore at U.S. Route 20. Unit VIII-B shall include the segment of Salt Creek from Porter County Road 700 North to the boundary of the Indiana Dunes National Lakeshore as it existed or the date of enactment of this subsection and shall include the historic site known as Gossett Cemetery. `(2) Within one year after the date of enactment of this subsection, the Secretary shall complete a protection plan for these areas which shall include (but shall not be limited to) a determination of the lands, waters, and interests therein to be acquired to provide for the protection of these riverine and wetland systems. The plan shall also include provisions for public access for the purposes of fishing, canoeing, hiking and other public activities consistent with continued wetland and resource protection. `(3) The Secretary shall, upon completion of the plan, publish a detailed description and map of the acquisition and protection boundaries established under the plan. Such map shall be available for public inspection. `(4) The Secretary is hereby granted such authority as may be required to implement and administer the plan. `(5) There are authorized to be appropriated such sums as may be necessary for acquisition of lands designated for acquisition under the plan prepared under this paragraph.'. SEC. 6. REPEAL OF LIMITATION ON CERTAIN ACQUISITION AUTHORITY. Section 12 of the Act (16 U.S.C. 460u-12) is repealed. SEC. 7. AUTHORIZATION OF APPROPRIATIONS. Section 9 of the Act (16 U.S.C. 460u-9) is amended by adding at the end the following: `In addition to amounts otherwise authorized to be appropriated to carry out this Act, there is authorized to be appropriated such sums as may be necessary to acquire lands and interests in lands as a result of the amendments made by the Indiana Dunes National Lakeshore Expansion Act of 1989.'.
