Directs the Secretary of Transportation not to approve any Federal aid highway project: (1) in any State which, within a specified two-year period, does not have in effect a program for random testing of driver's license and renewal applicants for the illegal use of controlled substances; and (2) for one year after such State has issued or renewed a driver's license to any individual who tests positive under its testing program.
Requires each State to: (1) annually certify to the Secretary that it has in effect such a program and is not issuing or renewing such driver's licenses; and (2) submit such information as the Secretary shall require to verify such certification. Directs the Secretary not to approve any project in any State which has failed to make such certification.

IN THE HOUSE OF REPRESENTATIVES May 31, 1989 Mr. SOLOMON introduced the following bill; which was referred to the Committee on Public Works and Transportation A BILL To amend title 23, United States Code, to require the random testing of applicants for drivers' licenses for the illegal use of controlled substances. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. RANDOM DRUG TESTING PROGRAM. (a) ESTABLISHMENT- Chapter 1 of title 23, United States Code, is amended by adding at the end thereof the following new section: `Sec. 159. Random driver's license drug testing program `(a) GENERAL RULES- `(1) TESTING PROGRAM- The Secretary shall not approve any project under section 106 of this title in any State which, after the last day of the 2-year period beginning on the date of the enactment of this section, does not have in effect a program for testing, on a random and nondiscriminatory basis, individuals applying for issuance of drivers' licenses and renewal of drivers' licenses for the illegal use of controlled substances. `(2) IMPLEMENTATION- If a State issues a driver's license to, or renews a drivers' license of, any individual who tests positive under its testing program under paragraph (1) for the illegal use of a controlled substance in the 1-year period beginning on the date of such test, the Secretary shall not approve any project under section 106 of this title in the State for 1 year after the date on which the Secretary determines that the State issued or renewed such license. `(b) CERTIFICATION- Each State shall certify to the Secretary before January 1 of each year beginning after the last day of the 2-year period beginning on the date of the enactment of this section that it has in effect a testing program in accordance with subsection (a)(1) and is not issuing or renewing drivers' licenses in accordance with subsection (a)(2). The Secretary shall not approve any project under section 106 of this title in any State which has failed to certify in accordance with this subsection. `(c) INFORMATION- Each State shall submit to the Secretary such information as the Secretary shall, by regulation, require as necessary, in his or her opinion, to verify the certification of such State under subsection (b). `(d) DEFINITIONS- As used in this section-- `(1) CONTROLLED SUBSTANCE- The term `controlled substance' has the meaning such term has under section 102 of the Controlled Substances Act (21 U.S.C. 802). `(2) DRIVER'S LICENSE- The term `driver's license' means a license issued by a State to an individual which authorizes the individual to operate a motor vehicle on highways. `(3) MOTOR VEHICLE- The term `motor vehicle' has the meaning such term has under section 154(b) of this title.'. (b) CONFORMING AMENDMENT- The analysis of chapter 1 of title 23, United States Code, is amended by adding at the end thereof the following: `159. Random driver's license drug testing program.'.
