Diabetes Prevention Act of 1989 - Amends the Public Health Service Act to authorize the Secretary of Health and Human Services to make grants to assist States in preventing or reducing morbidity and premature mortality resulting from diabetes, with particular emphasis on any population at risk.
Requires grantees to: (1) set aside 50 percent of the grant to make grants to community-based programs for carrying out the same purposes; (2) establish a comprehensive program of identifying individuals at risk of developing diabetes or related complications and providing such individuals with education and counseling with respect to receiving preventive health care; and (3) provide information and services in the language and cultural context most appropriate for the individuals for whom the information and services are intended.
Authorizes appropriations for FY 1990 through 1992.
Amends provisions of the Public Health Service Act relating to block grants to state that allotments under certain provisions for preventive health services may be used for services relating to the prevention of diabetes and related complications among populations at risk for diabetes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the `Diabetes Prevention Act of 1989'. SEC. 2. ESTABLISHMENT OF PROGRAM OF GRANTS FOR PREVENTION AND CONTROL OF DIABETES. Part B of title III of the Public Health Service Act (42 U.S.C. 243 et seq.) is amended by inserting after section 317A the following new section: `SEC. 317B. PROJECT GRANTS FOR DIABETES PREVENTION AND CONTROL. `(a) ESTABLISHMENT OF PROGRAM- `(1) IN GENERAL- The Secretary may make grants to the States and the political subdivisions of States for the purpose of assisting grantees in preventing or reducing morbidity and premature mortality resulting from diabetes, with particular emphasis on diabetes among any population at risk with respect to diabetes. `(2) SET-ASIDE FOR COMMUNITY-BASED PROGRAMS- The Secretary may not make a grant under paragraph (1) unless the applicant for the grant agrees to expend not less than 50 percent of the grant to make grants to community-based nonprofit programs for carrying out the purpose described in such paragraph. `(b) REQUIREMENT OF COMPREHENSIVE PROGRAM- The Secretary may not make a grant under subsection (a) unless the applicant for the grant agrees that, in carrying out the purpose described in subsection (a), the applicant will establish a comprehensive program of-- `(1) identifying individuals who are at risk of developing diabetes; `(2) identifying individuals who have diabetes and are at risk of developing complications related to diabetes; and `(3) providing to individuals identified under paragraph (1) or (2) appropriate education and counseling with respect to receiving preventive health care relating to diabetes. `(c) AUTHORIZED ACTIVITIES- Activities for which a grant under subsection (a) may be expended include, with respect to diabetes, conducting programs to educate the public, conducting testing programs, providing outreach services, and conducting research into the identification of individuals for purposes of paragraphs (1) and (2) of subsection (b). `(d) REQUIREMENT WITH RESPECT TO APPROPRIATE LANGUAGE AND CULTURAL CONTEXT- The Secretary may not make a grant under subsection (a) unless the applicant for the grant agrees to provide information and services under the grant in the language and cultural context most appropriate for the individuals for whom the information and services are intended. `(e) REQUIREMENT OF APPLICATION- The Secretary may not make a grant under subsection (a) unless-- `(1) an application for the grant is submitted to the Secretary; `(2) with respect to carrying out the purpose for which the grant is to be made, the application provides assurances of compliance satisfactory to the Secretary; and `(3) the application otherwise is in such form, is made in such manner, and contains such agreements, assurances, and information as the Secretary determines to be necessary to carry out such subsection. `(f) AUTHORIZATION OF APPROPRIATIONS- For the purpose of carrying out this section, there are authorized to be appropriated $30,000,000 for fiscal year 1990 and such sums as may be necessary for each of the fiscal years 1991 and 1992.'. SEC. 3. CLARIFICATION WITH RESPECT TO USE OF PREVENTIVE HEALTH SERVICES BLOCK GRANT FOR CERTAIN DIABETES PROGRAMS. Section 1904(a)(1)(C) of the Public Health Service Act (42 U.S.C. 300w-3(a)(1)(C)) is amended by striking `populations,' and inserting the following: `populations (including services relating to the prevention of diabetes and related complications among populations at risk with respect to such conditions),'. SEC. 4. EFFECTIVE DATE. The amendments made by this Act shall take effect October 1, 1989, or upon the date of the enactment of this Act, whichever occurs later.
